Terms of Service

1. Acceptance of Terms

By purchasing, setting up, or using the PlantSense device, PlantSense Connect app, or cloud services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PlantSense is a consumer IoT plant monitoring system consisting of a hardware sensor probe, the PlantSense Connect companion app (iOS and Android), and cloud infrastructure that stores and processes sensor data. The Service provides soil moisture, temperature, humidity, and light readings, push notifications, plant identification, and care recommendations.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate and complete registration information.

4. Permitted Use

The Service is intended for personal, non-commercial plant monitoring. You may not:

• Reverse-engineer, disassemble, or decompile the hardware or software.
• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to our servers or other users' accounts.
• Resell, sublicense, or redistribute the Service without prior written consent.

5. Hardware Warranty

PlantSense hardware is warranted against defects in materials and workmanship for one (1) year from the date of original purchase. This warranty does not cover damage caused by misuse, water submersion beyond the probe tip, unauthorized modification, or normal wear and tear. If your device is defective, contact support for a replacement.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SENSOR READINGS WILL BE PERFECTLY ACCURATE, THAT THE SERVICE WILL BE UNINTERRUPTED, OR THAT IT WILL MEET YOUR SPECIFIC REQUIREMENTS. PLANTSENSE IS NOT A SUBSTITUTE FOR PROFESSIONAL AGRICULTURAL OR HORTICULTURAL ADVICE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANTSENSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PLANTS, CROPS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PRICE YOU PAID FOR THE PLANTSENSE DEVICE.

8. Intellectual Property

All intellectual property rights in the Service, including software, firmware, designs, trademarks, and documentation, are owned by PlantSense or its licensors. Your purchase grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Termination

You may stop using the Service at any time by deleting your account in PlantSense Connect. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Francisco County, California.
